Terms and Conditions of Purchase

IMPORTANT: this document, together with the Legal Notice and the Privacy and Cookie Policy, must be read and accepted in order to access, browse and make purchases on the website. By placing an order, you declare that you have read, understood and accepted these terms.

Throughout this document, MYA WIFI S.L.U. will be referred to interchangeably as "the Seller", "La Tienda de las Licencias" or "we". The buyer will be referred to as "the Customer", "the Consumer" or "the User".

2.- Subject of the contract

La Tienda de las Licencias markets original and legal software licences (new and second-hand under the CJEU Judgment C-128/11 — UsedSoft v. Oracle) from manufacturers such as Microsoft, Bitdefender, ESET, Kaspersky, Norton, McAfee, Panda, Acronis, Veeam, among others.

Products are delivered exclusively in digital form, by email, automatically and instantly upon payment confirmation. No physical media is shipped (no DVDs, USB drives, boxes, etc.).

3.- Purchase process

Steps to place an order

  1. Select the products you want to purchase and add them to the basket.
  2. Access the basket from the icon at the top of the website. You can add, modify or remove products before proceeding to payment.
  3. You can purchase as a guest (without registering) or create an account. Fields marked with an asterisk are mandatory for proper order processing.
  4. Select the payment method, accept these terms and the privacy policy, and proceed to payment.
  5. Once payment is confirmed, the order is processed automatically and you receive the following by email:
    • Payment receipt (order number and transaction details).
    • Licence key or keys with the corresponding version.
    • Activation instructions and official download links where applicable.
    • Invoice with the Seller's NIF and applicable taxes (issued within minutes of purchase).

Limited stock: in promotions with limited units, the first person to complete payment secures the product. Adding products to the basket without paying does not create any right or binding contract. The sales contract is only perfected when payment has effectively been received.

Delivery time

Licence delivery is automatic and instant (usually within minutes) after payment confirmation. For bank transfer payments, delivery occurs once the transfer has been verified (24–72 business hours). If you have not received your order after that time, please check your spam folder and contact our support team.

4.- Prices and taxes

  1. Prices displayed on the website are expressed in euros (EUR) and include Spanish VAT at 21%, unless otherwise expressly stated.
  2. For customers resident in the Canary Islands, Ceuta or Melilla, invoices will be issued with I.G.I.C. / I.P.S.I. as applicable, provided the customer certifies their residence by means of NIF or equivalent document before purchase.
  3. For EU intra-community professional customers with a valid VAT number (registered in VIES), the reverse-charge mechanism will apply under Article 196 of Directive 2006/112/EC. The customer must provide their VAT number before purchasing.
  4. For customers outside the European Union, prices are displayed without Spanish VAT when the system detects the location. Any taxes, duties or fees that may apply in the destination country are borne by the customer.
  5. Local currency payments: customers in LATAM and other international markets may pay in their local currency through our payment gateways; in that case the exchange rate applied is the one the gateway applies at the time of payment.
  6. Price variations: prices shown on the website may change between the moment you add a product to the basket and the moment of payment, due to catalogue updates or promotional changes. The binding price is always the one displayed at the final payment step.
  7. Coupons and discounts: coupons must be entered in the designated field before completing the purchase. Coupons will not be applied to orders already paid. Coupons are non-transferable and subject to the date and conditions stated in the promotion.

5.- Payment methods

The Customer may choose between the following payment methods:

Some payment methods may involve additional fees charged by the gateway. The Seller reserves the right to reject certain methods depending on the customer's risk profile or geographical region, especially where there are signs of fraud.

Fraud prevention: suspicious transactions may be verified before the licence is delivered. In the event of a chargeback or unjustified dispute after the licence has been delivered, the Seller reserves the right to revoke the licence, block the customer and claim any resulting damages.

6.- Software warranty

Origin and validity of licences

La Tienda de las Licencias obtains its licences from verified suppliers within the European Economic Area and maintains documented traceability of the origin of each licence. We guarantee that all licences sold are authentic, original, activatable and legally valid under the CJEU Judgment of 3 July 2012 (Case C-128/11, UsedSoft v. Oracle).

Warranty period

The Customer has a period of 30 calendar days from receipt of the licence to verify its operation and report any issues. After that period, the Seller cannot guarantee that the Customer has not resold, transferred or shared the key with third parties, and the right to claim for invalidity is therefore lost.

Defective licences

If the licence does not work correctly, please follow these steps before filing a claim:

  1. Check your internet connection and the correct configuration of your device.
  2. Review the minimum requirements indicated on the product page and make sure your device meets them.
  3. Test the licence on another device to rule out issues with the customer's system. Do not install the licence on a second device without first uninstalling it from the first.
  4. If the licence still does not work, contact soporte@latiendadelaslicencias.com providing the order number, error code and screenshots.

Incident resolution process

Replacement policy:

1. In the case of a verified defective licence, a second licence will be provided free of charge.

2. If the second licence does not work either, a third licence with assisted remote installation will be offered at the Seller's expense.

3. If after exhausting the replacement options the licence still does not work due to reasons attributable to the Seller, a full refund of the amount paid will be issued.

7.- Right of withdrawal

IMPORTANT — digital content: the right of withdrawal does not apply to software licences delivered by digital means where the Customer has received and/or activated the key, in accordance with Article 103.m) of Royal Legislative Decree 1/2007 (TRLGDCU). By completing the purchase, the Customer expressly consents to the immediate start of the digital supply and acknowledges that, as a result, the right of withdrawal is lost.

Applicable legislation is quoted below:

Article 103 TRLGDCU — Exceptions to the right of withdrawal:
"The right of withdrawal shall not apply to contracts relating to: (…) m) The supply of digital content not provided on a tangible medium where performance has begun with the consumer's prior express consent and acknowledgement that the consumer thereby loses the right of withdrawal."

Cases where withdrawal does apply

Exceptionally, the right of withdrawal may be exercised in the following cases:

  • When the Customer has paid for an order but has not yet received or viewed the licence key.
  • When there has been a clear error by the Seller (wrong product, incorrect version, etc.) and the Customer has not activated the licence.

In these cases, the Customer has 14 calendar days from receipt of the product to exercise their right of withdrawal. It is sufficient to send a communication to soporte@latiendadelaslicencias.com with the subject "Withdrawal", stating the order number, customer details and reason. The refund will be made within the following 14 calendar days using the same payment method used for the purchase.

8.- Conditions for resellers and professionals

La Tienda de las Licencias offers a dedicated reseller programme (IT shops, self-employed technicians, IT service companies) with special conditions:

  • 30% discount on Windows Server, SQL Server and RDS.
  • 20% discount on all other licences.
  • 10% discount on Microsoft 365 products.
  • Additional volume rebate, determined individually based on annual turnover.
  • Access to the dedicated portal distribuidores.latiendadelaslicencias.com.

Reseller status must be previously accredited with a professional tax ID and verified by the Seller. B2B relationships are governed by these terms and by any specific conditions agreed in writing.

9.- General terms of sale

  1. The Seller is responsible for offers, prices, product descriptions and consumer rights in accordance with applicable legislation.
  2. The Seller assumes no liability for force majeure, improper use of the product, use contrary to the manufacturer's instructions, criminal use or, in general, any inappropriate use that breaches the principles of good faith.
  3. The Seller is not liable for the impossibility of delivery due to incorrect, incomplete or false data provided by the Customer.
  4. If a paid product is unavailable due to the Seller's error, the Customer will be offered an alternative of equal or higher value, or a full refund of the amount paid.
  5. The Seller is not liable for opinions, reviews or comments published by third parties on the website or on external platforms.
  6. No verbal contracts or exchanges of emails will be accepted as binding contracts other than these terms, except for documents electronically signed by both parties.

10.- Data protection

The processing of the Customer's personal data is governed by Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD), as set out in our Privacy and Cookie Policy.

The Customer may exercise their rights of access, rectification, erasure, restriction, portability, objection and the right not to be subject to automated decisions by sending an email to soporte@latiendadelaslicencias.com.

11.- Dispute resolution

Amicable resolution

Before starting any formal claim, we recommend that you contact our customer service team. The vast majority of issues are resolved in under 24 business hours.

European Online Dispute Resolution (ODR) platform

In accordance with Regulation (EU) 524/2013, consumers have the right to request the out-of-court settlement of disputes through the European Commission's online dispute resolution platform:

Competent jurisdiction

For end consumers, the court of the consumer's domicile shall have jurisdiction, in accordance with consumer protection rules.

For B2B relationships (sales between professionals, resellers and companies), the parties expressly submit to the Courts of Ponferrada (León), waiving any other jurisdiction to which they may be entitled.

12.- Applicable law

These Terms and Conditions are governed by Spanish law, in particular:

  • Royal Legislative Decree 1/2007 (TRLGDCU) — Consolidated Text of the General Law for the Defence of Consumers and Users.
  • Law 34/2002 (LSSI-CE) — Information Society Services and Electronic Commerce.
  • Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD).
  • Law 58/2003 General Tax Law and electronic invoicing regulations.
  • CJEU Judgment of 3 July 2012 (Case C-128/11, UsedSoft v. Oracle).
  • Regulation (EU) 524/2013 on online dispute resolution.

13.- Modifications and partial invalidity

The Seller reserves the right to modify these Terms and Conditions at any time, with the sole requirement of updating the date at the top of the document. The version applicable to each purchase will be the one in force at the time of ordering.

If any of the clauses of this document are declared null and void, in whole or in part, the remaining clauses will remain in force.
